Eligibility

Joey's Kids Club ("Kids Club") is available for children up to the age of 12. Registration in the Kids Club is voluntary, has no monetary value and is subject to these terms and conditions. Registration will be completed once all necessary membership information has been provided and the parent or legal guardian has confirmed that he or she has read and accepted these terms and conditions as well as Joey's Franchising Ltd. ("Joey's") Privacy Policy. The registration of a child in the Kids Club must be performed by a consenting parent or legal guardian.

Enrollment

In order to register, the parent or legal guardian must provide personal information to identify the child. Enrollment in the Joey's Kids Club Program is available online at joeys.ca/kidsclub. Parents or Legal Guardians must provide a valid e-mail address in order to receive all benefits associated with the Kids Club.

Privacy Policy

By enrolling his or her child in the Kids Club, the parent or legal guardian agrees and acknowledges that the personal information collected will be used and stored for the purpose of the registration of the child and for granting the member the various benefits of the Kids Club. Joey's is committed to respecting the privacy of its users' personal information and is subject to Joey's Privacy Policy found at joeys.ca/privacy-policy.

Benefits

The benefits associated with the Kids Club include the following:

• A birthday promotional offer for each child turning 12 years or younger.
• Special promotional offers, contests and giveaways exclusive to members.

These benefits are subject to change without prior notice.

Cancellation; Termination.

A parent or legal guardian may cancel a child's Kids Club membership at any time by clicking unsubscribe from an email, and following the instructions.

At any time, Joey's has the right to terminate or revoke, in it sole discretion, any membership into the Kids Club if the child no longer meets the eligibility criteria or if Joye's has a reason to believe that the information provided or any declaration made at the time of registration is false or inaccurate, in whole or in part. Joey's shall not be liable for any damage or loss arising from a failure by the parent or the legal guardian to comply with these requirements as described in these terms and conditions.

Joey's has the right at any time, without notice and in its sole discretion, to modify, temporarily or permanently suspend or terminate the Kids Club. Joey's assumes no liability for any changes to the benefits associated with the program and these terms and conditions. The parent or the legal guardian is responsible to notify the Kids Club as soon as possible about any unauthorized use or security breach of personal information. Moreover, it is the responsibility of the parent or the legal guardian to ensure that their child or a third-party does not complete the online registration form without their consent.

Changes to Terms and Conditions

Joey's may change these Terms and Conditions at any time without notice or liability by posting a revised Agreement on the Kids Club webpage located at joeys.ca/kids/terms. Any change shall take effect immediately, unless otherwise provided. The user may view the current version of these Terms and Conditions at any time online at joeys.ca/kids/terms.

Governing Law

Any use, intervention, privileges that may be associated with the Kids Club as well as these terms and conditions are governed by the laws of Canada, when applicable. The parent or legal guardian consents that all disputes relating to or arising in any way form the Kids Club shall be exvlusively submitted to the courts in the District of Calgary in the province of Alberta.

Any provision in these terms and conditions which is or becomes illegal, invalid or unenforceable shall be served herefrom and shall be ineffective to the extent of such illegality, invalidity or unenforceability and shall not in any way affect or impair the remaining provisions hereof, which shall remain in full force and effect.
